Tolerable Allowance
Permissible limits established in trade agreements allow a minor percentage of non-originating fibers to be present in a garment without disqualifying the item from preferential duty treatment. The de minimis weight threshold typically permits up to ten percent of the total weight of the elastomeric or decorative fibers to originate from outside the trade zone. This rule protects complex fabric designs from losing tariff benefits due to minor functional additions.
Weight Calculation
Determining eligibility requires a precise laboratory analysis of the yarn composition of the fabric. Technicians calculate the dry weight of each fiber type after removing all finishes and coatings. This data is compared against the production specifications to confirm that the foreign material does not exceed the limit.
Origin Exception
If the non-originating yarn exceeds the permitted threshold by even a fraction of a percent, the entire garment loses its preferential origin status. The importer must then pay the standard customs duty on the total value of the shipment. This binary outcome makes precise weight calculations a mandatory part of fabric development.
Customs Enforcement
Exemptions are tightly controlled and vary by fiber type. For elastomeric yarns, the limit is often lower or excluded entirely under certain agreements.
