Through reference laboratory arbitration, an accredited external laboratory conducts unbiased testing on a retained sample of the disputed material to deliver a definitive verdict. This process provides a legally binding resolution that prevents protracted litigation between garment factories and fabric suppliers.
Sampling Protocol
An arbitrator must use sample material that was sealed and stored under controlled conditions at the time of the initial inspection. This ensures that the tested material has not been exposed to humidity, heat, mechanical action, or dirt that could alter the results. The sample is divided and tested in parallel to guarantee high precision.
Cost Allocation
Contracts specify which party pays for this arbitration based on the outcome of the final test. If the reference laboratory confirms the seller’s initial results, the buyer covers all test fees and must accept the shipment. If the arbitrator finds the fabric is indeed defective, the seller pays the testing fees and faces penalties or order cancellation.
Lab Qualification
The designated arbitration facility must hold internationally recognized accreditations like ISO seventeen zero twenty-five and cannot have any financial ties to either the buyer or the seller. This independence guarantees that the test methods and equipment calibrations are of the highest standard. Having a predetermined referee laboratory in the supply contract is essential for maintaining smooth commercial transactions across international borders.
